What are PF and ESI registrations?

PF registration enrols an establishment with the Employees’ Provident Fund Organisation. It facilitates provident fund, pension and deposit-linked insurance benefits for eligible employees.

ESI registration enrols an establishment with the Employees’ State Insurance Corporation. It provides eligible employees and their families with medical care and benefits relating to sickness, maternity, employment injury, disablement and dependants.

When is PF registration mandatory?

PF registration is generally mandatory for every establishment employing 20 or more employees.

Under the current framework, PF applicability is not restricted only to specified or scheduled industries; it extends to establishments meeting the prescribed employee threshold.

When is ESI registration mandatory?

ESI registration generally applies to every establishment employing 10 or more persons, other than a seasonal factory.

An establishment engaged in a notified hazardous or life-threatening activity may also be covered even where only one employee is employed.

Which employees are covered under ESI?

Employees whose wages are within the prescribed ESI wage ceiling are generally covered under the scheme.

At present, the notified wage ceiling for ESI coverage is ₹21,000 per month. Coverage must be determined using the applicable statutory definition of wages.

Are temporary and contractual employees considered for PF and ESI registration?

Employee strength should not be assessed by considering only permanent employees. Depending on the employment arrangement and applicable provisions, temporary, casual and eligible contract workers may also need to be considered.

A principal employer should also verify whether contractors have properly registered and enrolled eligible contract workers.

Can an establishment register voluntarily when its employee strength is below the prescribed limit?

Yes. An establishment having fewer than 20 employees may seek voluntary PF coverage where the employer and the required majority of employees agree to such coverage.

Voluntary registration should be considered carefully because it creates continuing contribution, filing and record-maintenance responsibilities.

Do newly incorporated companies automatically receive PF and ESI registration numbers?

New Private Limited Companies, Public Limited Companies and One Person Companies generally receive EPFO and ESIC registration numbers through the SPICe+ and AGILE-PRO-S incorporation process.

However, receiving registration numbers does not necessarily mean that monthly contributions become payable immediately. Actual compliance begins when the applicable employee threshold and employee-coverage conditions are satisfied.

What documents are generally required for PF and ESI registration?

The following documents and information are generally required:

  • PAN and constitution documents of the establishment
  • Certificate of incorporation, partnership deed or LLP agreement
  • Registered-office or business-premises proof
